Welcome to Trepup! These Trepup Terms of Service ("terms of service") govern your access to and use of Trepup’s website and services, operated by Trepup.com AG and its affiliates ("Trepup," "we," "us"). By accessing or using Trepup, you agree to comply with these terms of service, which form the core agreement between you and Trepup. If you do not agree to these terms of service, please discontinue your use of Trepup.
Trepup is a global ecommerce platform designed to facilitate connections and interactions between users. Our platform allows users to list, browse, and engage with a variety of products and services. While Trepup provides the tools and technology to support these interactions, all transactions for products and services listed by users are conducted directly between the users outside of Trepup. Trepup acts solely as a facilitator of these connections.
By using Trepup, you also agree to comply with our Trepup Privacy Notice ("privacy notice"), Trepup Cookies Policy ("cookies policy"), and any other applicable Legal Policies ("legal policies"). These terms of service should be read in conjunction with the legal policies. In the event of a conflict between these terms of service and the legal policies, the legal policies will take precedence solely with respect to the conflicting provision.
By agreeing to these terms of service, you confirm that you have the legal capacity to enter into a binding contract under the applicable laws of your jurisdiction, including, but not limited to, the Swiss Civil Code, the Swiss Code of Obligations, and the Swiss Federal Data Protection Act (FADP).
Trepup is designed to comply with Swiss law. If you access Trepup from outside Switzerland, you are solely responsible for ensuring your use complies with all applicable local laws and regulations. Additionally, by using Trepup, you acknowledge that some products and services listed on the platform may originate from jurisdictions other than your own. You accept responsibility for understanding and adhering to any applicable import, export, or other regulatory requirements.
If we determine that your use of Trepup violates these terms of service, the legal policies, or any applicable law, we reserve the right to take corrective action. This includes, but is not limited to, restricting your access to Trepup, suspending your account, or notifying relevant authorities. Trepup retains the right to pursue all remedies available under applicable law for violations.
You may discontinue your use of Trepup and delete your account at any time in accordance with these terms of service. Similarly, Trepup reserves the right to suspend or terminate its services or the availability of the website, in whole or in part, at any time and without prior notice.
If disputes arise between users over a potential breach of these terms of service or the legal policies, we encourage you to contact us. Trepup will review such matters and take actions as deemed appropriate at its sole discretion. For certain cases, we may provide user contact information if required by law or under the legal policies.

Your Trepup account is your gateway to connection, creativity, and commerce. Upon signing up, you will receive a unique User Standard Identification Number ("USIN" or "Account ID")—a 13-character alphanumeric identifier that ensures your individuality and enhances your experience on the platform.
To create an account, you must meet specific eligibility criteria, including being at least 16 years old or meeting the minimum legal age to enter into a binding agreement in your jurisdiction. Trepup does not allow the use of its services by individuals under this age. Users under this age are strictly prohibited from creating accounts on Trepup, in compliance with global privacy laws. This reflects global privacy standards, where legal restrictions—such as Australia’s Privacy and Other Legislation Amendment Bill 2024—cannot be overridden by parental supervision. Trepup cannot be held responsible for unauthorized use of its services by individuals who do not meet these eligibility criteria.
As an account holder, you are responsible for safeguarding your sign-in credentials, including your username and password. You agree that any activity conducted through your account will be considered authorized by you unless you promptly notify Trepup of unauthorized access. To ensure smooth account operation, it is your responsibility to maintain accurate and up-to-date account information.
Trepup reserves the right to review, deactivate, or delete accounts that remain inactive for a period of six months, exhibit unauthorized or suspicious behavior, or violate these terms of service or the legal policies. In such cases, Trepup will notify you and provide an opportunity to address the issue before any action is taken, except where doing so is prohibited by applicable law.
By creating a Trepup account, you are granted a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use the platform for lawful personal or professional purposes. This license does not permit reproducing, duplicating, or exploiting Trepup’s proprietary tools, content, or systems beyond what is explicitly authorized by the legal policies, nor does it allow circumventing any security features or measures implemented on the platform. Compliance with these terms of service and the legal policies is a strict condition for retaining your license to use Trepup.

Your content must not:
- Contain harmful, unlawful, or invasive material, such as sexually explicit or discriminatory content.
- Promote discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
- Include spam, malicious code, or other unsolicited communications.
- Infringe intellectual property rights or mislead others about the origin of content, such as impersonation or fabricated reviews.
Trepup reserves the right to review, modify, or remove content that violates these terms or compromises platform integrity. If your content is removed, you may request clarification or appeal the decision.
Acceptable use guidelines
To maintain a respectful and secure environment, you agree to:

- Engage authentically and respectfully with the community to foster trust and collaboration.
- Report vulnerabilities, suspicious activities, or violations to enhance platform security.
You agree not to:
- Use Trepup for fraudulent or illegal activities, such as listing stolen or pirated items.
- Misrepresent your identity, affiliations, or intentions.
- Circumvent Trepup’s systems, manipulate features, or engage in actions that expose Trepup to legal or reputational risks.
- Introduce harmful code, exploit system vulnerabilities, or attempt unauthorized access.
- Facilitate violations of these terms or engage in activities threatening public safety or national security.
Trepup actively monitors for violations to ensure platform integrity. If you identify vulnerabilities or suspect violations, report them promptly through the Vulnerability Reporting Form (coming soon).
Appeals, disputes, and localization
If your content is flagged or removed, you may:

: Contact security@trepup.com within 14 days, providing relevant details.

Submit an appeal
: Include your account information, content description, and the reason for your appeal.
Trepup will review your appeal and communicate its decision within 10 business days. If unresolved:
- Request impartial mediation by contacting mediation@trepup.com.
- Pursue legal action under Swiss law if mediation fails, limited to the courts of Zug, Switzerland.
For users outside Switzerland:
- Appeals and mediation are conducted in English to ensure accessibility.
- Local consumer protection laws apply where required, preserving your rights in the event of a conflict with these terms.
- If legal proceedings are necessary, they may be subject to your local laws if required by consumer protection regulations; otherwise, Swiss jurisdiction applies.
By adhering to these guidelines and engaging in Trepup’s resolution processes, you help foster fairness, transparency, and trust within the Trepup community.

By creating a Trepup Account, you consent to being contacted through the email address, phone number, or any other contact information associated with your account, including linked social media accounts. We may contact you for the following purposes:

- Using another user’s information for marketing purposes through electronic or other means.
Misuse of user information is a violation of these terms of service and may result in corrective actions, including account suspension or legal recourse.

The name "Trepup" and all corresponding marks, logos, designs, trade dress, and trademarks that we use in connection with the website are Trepup’s intellectual property and may only be used in accordance with our Trepup Brand Guidelines Policy ("brand guidelines policy").
All intellectual property on Trepup, including graphics, images, logos, trademarks, the appearance, organization, and layout of the website, the underlying software code, and proprietary materials or information made available by Trepup, is our exclusive property.
You grant Trepup and its users a royalty-free, non-exclusive, irrevocable, perpetual, sublicensable, assignable, unrestricted, worldwide right and license to use, store, display, reproduce, save, modify, create derivative works from, and distribute your user content for all business purposes, including operating, developing, providing, and using Trepup. This license will not lapse due to non-use of your user content. These terms of service do not restrict any additional rights Trepup may have regarding user content.
You also authorize Trepup to use automated tools to translate user content and communications into local languages where such solutions are available. Trepup may also provide translation tools for your use. However, the accuracy and availability of translations are not guaranteed.
You represent and warrant that you have all necessary rights to provide user content on Trepup and that your user content does not infringe any third-party rights, including intellectual property or privacy rights.
While your user content remains your property, any compilation of your user content with Trepup’s proprietary materials, logos, graphics, text, icons, images, audio clips, digital downloads, data compilations, software, or derivative works created using any user content will remain the property of Trepup or its users, as applicable. These materials are protected under applicable intellectual property laws.
You may not copy, modify, alter, decompile, reverse engineer, publish, broadcast, distribute, sell, or transfer any material, information, or content that is not your property unless expressly permitted under these terms of service.
If you believe any user content infringes your intellectual property rights, please notify Trepup in accordance with our intellectual property rights policy.

This section outlines your responsibility to protect Trepup from claims or disputes that may arise due to your use of the platform. Why this matters
This indemnity obligation continues even after you stop using Trepup or close your account. It protects Trepup’s ability to operate reliably and ensures the integrity of the platform for all users.

Trepup strives to provide uninterrupted access to its platform; however, we cannot guarantee that the website will always be available or free from interruptions. Access to Trepup may be temporarily suspended or restricted at any time, without prior notice, for purposes including, but not limited to, scheduled maintenance, updates, repairs, or improvements.
We make no warranties or representations regarding the following:
- The website's continuous or consistent availability.
- The completeness, accuracy, or reliability of the information provided on Trepup.
- The security of the website or its immunity from viruses, trojans, malware, or other harmful components.
- That user content on Trepup does not infringe third-party intellectual property rights.

Trepup assumes no responsibility for any product or service offered or displayed on the website.
Trepup does not take responsibility for user content, including any advice, opinions, or materials shared by users. Content posted or transmitted by users is for general informational purposes only and may not meet your specific requirements. By using Trepup, you agree that you may encounter user content that is inaccurate, offensive, or unsuitable, and you accept these risks.
Any material downloaded or otherwise obtained through the website is done at your discretion and risk. Trepup will not be liable for any damage to your devices or loss of data caused by such downloads. Trepup does not guarantee the quality, legality, or safety of items advertised on the platform, the truth or accuracy of descriptions, or the ability of users to complete transactions. You acknowledge that Trepup has no control over these matters and does not assume liability for any outcomes related to user transactions.
Trepup shall not be held liable for any delays, failures, or disruptions resulting from causes beyond its reasonable control, including but not limited to internet failures, power outages, labor disputes, natural disasters, governmental actions, or third-party non-performance.
You are responsible for maintaining the security of your Trepup account credentials. Trepup is not liable for any loss or damages resulting from unauthorized access to your account caused by your failure to secure your credentials. Trepup reserves the right to suspend or terminate accounts without liability in such cases.
To the extent permitted by law, the aggregate liability of Trepup, its affiliates, employees, and agents for all claims arising from your use of the website during any calendar year shall not exceed one hundred Swiss Francs (CHF 100). This limitation applies regardless of the nature of the claim.
The exclusions and limitations in this section do not apply to liability arising from gross negligence, intentional misconduct, personal injury, or damages resulting from breaches of essential obligations under applicable law. Trepup’s liability will always comply with statutory requirements.

: These terms of service, the legal policies, and any disputes arising from their formation, execution, or termination shall be governed by the substantive laws of Switzerland, excluding its conflict of law rules and international treaties, such as the United Nations Convention on Contracts for the International Sale of Goods. The exclusive jurisdiction for resolving disputes is the courts of Zug, Switzerland.
