Brand Usage

This Trepup Brand Usage policy delineates the framework within which Trepup brand assets, encompassing trademarks, service marks, trade names, trade dress, and logos (collectively referred to as "Trepup Marks"), are to be employed. This policy is pivotal in preserving the uniformity and integrity of Trepup Marks, ensuring they are utilized in a manner that reflects the brand’s ethos and values. Misuse or unauthorized application of Trepup Marks could lead to the revocation of your license and/or permission to use these assets.

This policy extends to all individuals under your employ or representation, including but not limited to your employees, officers, and agents, as well as any successors or assigns or any entity utilizing Trepup Marks under your guidance.

In drafting this policy, we have striven for clarity and inclusivity, ensuring that its provisions are accessible to and respectful of all users. This document is to be interpreted in harmony with the Terms of Service and the Policies. Where terms are not expressly defined within this policy, they shall assume the definitions provided in the Terms of Service. Our brand

Trepup is the owner of national and international trademark registrations that cover and protect its brand names, including wordmarks and their styling. As a general rule, you are permitted to use Trepup Marks in the manner prescribed by this policy and the Brand Guidelines.

You acknowledge the immense value of Trepup Marks to Trepup and agree that the restrictions outlined in this policy are necessary to maintain the strength of the Trepup brand and prevent any brand dilution.

Specifications for use

If you are authorized to use Trepup Marks, you must

• comply with the specifications provided in the Brand Guidelines.
• identify registered Trepup Marks with the appropriate registered trademark ® or TM symbol, as applicable.
• acknowledge that Trepup Marks are owned by Trepup, and agree that all goodwill derived from their use inures exclusively to the benefit of Trepup. When using any Trepup Marks on your website, document, or other material, include the following attribution in a legible font and size:

  "[●] is a trademark of Trepup.com AG and/or its affiliates. All rights reserved."

• use Trepup Marks in connection with products and services, websites, book titles, magazines, newspapers, blogs, periodicals, seminars, or conferences by appending the following phrase:

  "[Name of product/service/publication] is an independent [type, e.g., article, blog, book, journal, service, website] and has not been authorized, sponsored, or otherwise approved by Trepup."

• use only the approved Trepup Marks that are provided on the website and have been officially approved by us in writing.
• avoid abbreviating, hyphenating, creating acronyms, changing the spelling, capitalization, or appearance, adding or deleting any words or spacing, changing any color or proportion, using it in a tagline or slogan, adding visual effects, angling, or rotating or in any way modifying the logo or design of Trepup Marks.
• ensure that Trepup Marks are adequately spaced from other elements on the web page.

Use restrictions

You agree, represent, and warrant that you will not use Trepup Marks to

• violate any of the Policies or applicable law.
• serve as a mark for your products or services.
• imply incorrectly or create the risk of misleading third parties as to Trepup's affiliation with, or sponsorship, endorsement, or approval of your products or services.
• associate with any counterfeit, fake, or replica products, services, or digital content.
• appear on or in connection with any website or application where any harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, racially, or ethnically objectionable, disparaging, or otherwise unlawful content is displayed.
• suggest a common, descriptive, or generic meaning.
• relate to, or connect with the name or sponsorship of any educational institutions, testing centers, or any facilities that are subject to governmental accreditation, authorization, oversight, or regulations.
• be used in the context of, or in connection with, any franchise agreement, relationships, or discussions with third parties.

Protection of Trepup

You will not cause, do, or authorize any action that, in the sole discretion of Trepup, may

• impair, damage, or be detrimental to the rights, reputation, and goodwill associated with Trepup.
• bring Trepup into disrepute or result in giving rise to a claim by any third party.
• result in the use of Trepup Marks in a manner that disparages, dilutes, or damages Trepup, including the use of any Trepup Marks in a manner that is offensive, defamatory, illegal, or unethical.
• lead to the infringement of intellectual property rights of any third party.

You agree that Trepup has the sole discretion to determine whether your use of Trepup Marks dilutes, tarnishes, or otherwise damages Trepup Marks. In such cases and upon receiving a notification from Trepup, you must immediately cease all use of Trepup Marks.

Maintenance and prosecution

You agree and acknowledge that Trepup has the sole right to file, prosecute, and maintain all Trepup Marks and that you will not

• make any claim to Trepup Marks or lodge any filings with respect to Trepup Marks or marks confusingly similar to Trepup Marks, whether on behalf of Trepup or in your own name or interest.
• register or attempt to register Trepup Marks as part of, in combination with, or in connection with any other marks or source identifiers, including domain names, URLs, and social media handles.
• question, challenge, or dispute the ownership of the intellectual property rights of Trepup in Trepup Marks, assist any person in doing so, or undertake any action that interferes with Trepup's rights in Trepup Marks.
• make any representations or perform any acts that may suggest you have any right, title, or interest in or to Trepup Marks, except for the right to use them as explicitly permitted in this policy.

Use of other marks

You agree and acknowledge that your use of other marks, brands, trade names, trade dress, and logos in connection with your products or services must not infringe upon Trepup Marks, and you will not

• use any marks or other words that closely mimic or could be confused with Trepup Marks.
• imitate the distinctive and unique design, logos, or typefaces of Trepup Marks.
• create any composite marks with Trepup Marks or use Trepup Marks in a manner that places them in close proximity to other marks, creating the impression of a composite or affiliated mark.

Infringement of any Trepup Marks

In the event you, either unknowingly or knowingly, infringe upon any Trepup Marks, we reserve the right to take all necessary actions to enforce our rights. Such actions may include, but are not limited to

• sending you a notice to inform you of the infringement.
• initiating legal proceedings against you.
• suspending or terminating your Trepup Account or instituting posting restrictions.
• notifying other users, your customers, or vendors about the infringement.
• alerting any relevant governmental authorities regarding the infringement.
